Projeto simplifica cancelamento de serviços de internet e telefonia

Com vistas a simplificar o cancelamento de contratos com operadoras prestadoras de serviços de internet e telefonia, está em análise no Senado Federal o Projeto de Lei (PL 4.855/2024) que determina que essas empresas disponibilizem a opção de rescisão de contratos de forma online, nas suas páginas na internet. A medida será obrigatória, com efeito imediato de cancelamento do serviço.

O autor do projeto, senador Styvenson Valentim (Podemos-RN), destacou na justificativa da proposta que a medida protege os consumidores de práticas abusivas pelas empresas no momento da rescisão de planos.

“A nova legislação proposta impede práticas abusivas, como cobranças após o pedido de cancelamento, e determina que as informações sobre a rescisão sejam apresentadas de forma objetiva”, disse na justificativa.

Pelo texto, fica proibida a cobrança de valores referentes a serviços prestados após o pedido de rescisão. Nesse caso, será responsabilidade da prestadora arcar com eventuais encargos decorrentes de falhas na comunicação durante o processo de cancelamento dos contratos.

“Os consumidores encontram obstáculos para cancelar esses serviços devido a excessos burocráticos e à necessidade de contato com centrais de atendimento. Tais práticas contrariam os princípios do Código de Defesa do Consumidor (CDC), causam insatisfação e comprometem a reputação das empresas de telecomunicações”, argumentou o senador.

A proposta está em análise na Comissão de Comunicação e Direito Digital (CCDD).
